Attorneys for migrants who are being held under Texas Gov. Greg Abbott's "Operation Lone Star" have filed a federal lawsuit to stop the practice.

The suit seeks class-action status for all of the migrants who are held by the state.

According to data obtained by the Texas Tribune, Texas authorities have arrested thousands of migrants suspected of entering the country illegally since last year's Operation Lone Star began.

The federal government is responsible for immigration, so the state is accused of violating its own policies by arresting people.

It also claims that migrants who are arrested are often held for weeks or months without being formally charged or having access to a lawyer, and in some cases have been kept in custody after posting bond.

Abbott has defended the policy in the past, though his office did not respond to a request for comment from Forbes.

The first challenge to Operation Lone Star appears to be a suit.

There are cases in which law enforcement has directed individuals from public property to a certain location, only to then arrest them for trespass once they get there, according to the lawsuit.

Abbott has made immigration the centerpiece of his campaign as he seeks a third term as governor. The governor has repeatedly claimed that President Joe Biden and Democrats in Congress are to blame for a surge of migrants along the border, and has recently blasted the president for plans to end Title 42, a policy that largely prohibits asylum seekers from staying in the U.S. The White House labeled the program a publicity stunt, but Abbott said he was sending a message to the Biden Administration. He lifted the order on enhanced inspections on April 15 because of long waits for trucks. According to the Texas Tribune, no drugs were found during the inspections.

A restraining order was issued by a federal judge on Wednesday to prevent the Biden Administration from ending Title 42. The policy was supposed to end by May 23.
