  • The $700 million CARES Act loan was approved by the Trump administration.

  • The loan was approved despite objections from the Defense Department.

  • The House Select Subcommittee said that company executives wanted to use government funds for long-term capital investments.

The Department of Defense objected to the $700 million in loans being given to a trucking company tied to the former president.

Democrats on the Select Subcommittee said that senior Trump officials were involved in getting the loan approved for Yellow Corporation.

Chairman James Clyburn said in the press release that the report reveals another example of the Trump Administration ignoring their obligation to be responsible stewards of taxpayer dollars.

The release said that political appointees risked hundreds of millions of dollars in public funds against the recommendations of career DOD officials.

The New York Times reported that the CARES Act allocated $17 billion for companies that were considered critical to national security. The Select Subcommittee found that the loan to Yellow represented 85% of the total funds disbursed.

The report by the Select Subcommittee found that DOD officials recommended against certifying the company as critical to maintaining national security, and that other companies could replace the trucking services Yellow provided to the DOD.

The Justice Department announced in March that they were filing a lawsuit against Yellow for fraudulently overcharging the DOD.

According to the report, in June of 2020 the Treasury Secretary requested a phone call with the Defense Secretary after he was told that the DOD was not planning to classify Yellow as critical. The company was certified as critical by the DOD after the phone call, making it eligible for a $700 million loan.

The report said that immediately after the Treasury decided to award Yellow the loan, Treasury Secretary Steven Mnuchin sent an email to the Chief of Staff and other close aides to the President praising him.

Insider couldn't get in touch with Mnuchin on Wednesday. The DOD staff determined that the firm met the criteria for loan eligibility and was considered critical to national security, according to Jonathan Hoffman.

Few reasonable people can argue that in the middle of a global Pandemic that was destroying businesses, the Department of Defense could potentially lose 1/3 to 1/3 of its domestic shipping of equipment and supplies.

According to the subcommittee, yellow executives wanted to use government funds for long-term capital investments to update the company's aging truck fleet despite the fact that the loans were supposed to offset company losses.

While we had our hand in the cookie jar, we thought we would try to catch up on capex while we were at it.

Heather Nauert told Insider that the loan had bipartisan support and helped preserve 30,000 jobs.

The intended use of the loan funds, including for capital expenditures, was the subject of extensive negotiations with the Treasury.

In a letter sent to the Select Subcommittee, a lawyer from Kasowitz Benson Torres said the allegations against the company in the report were false.

The eligibility for and use of its CARES Act funds is, was, and continues to be appropriate, according to the letter.
