Donald Trump is appealing a New York judge's decision to hold the former president in contempt of court and fine him $10,000 per day for failing to comply with a subpoena.

The second time in two months that Trump has sought to overturn a Manhattan judge, his lawyer filed a notice of appeal on Wednesday.

In court papers, Habba questioned the legal basis for the contempt ruling, arguing that Trump had responded properly to the subpoena and that the Attorney General had failed to show his conduct was calculated to defeat.

Habba argued that the office refused to engage in good-faith discussions before trying to have Trump fined. Habba said that all documents responsive to the subpoena were produced to the attorney general months ago.

James said in a statement that the order of the court was clear that Trump was in contempt.

Trump is challenging the Feb. 17 ruling requiring him to answer questions under oath. According to James, the probe found evidence that Trump may have overstated the value of assets for more than a decade. The arguments in that appeal are scheduled for May 11.

Along with its subpoena for Trump's testimony, James office issued a subpoena for numerous documents, including paperwork and communications pertaining to his financial statements, financing and debt for a Chicago hotel project and development plans for his Seven Springs Estate north of New York City.

James, a Democrat, asked the court to hold Trump in contempt after he failed to produce any documents by a March 31 deadline. Trump and his lawyers failed to document the steps they had taken to search for the documents, as well as failing to meet the deadline, according to the ruling.

Instead, Trump produced 16 pages of objections and four pages of anAffirmation by his Counsel that stated that Mr. Trump was unable to locate any responsive documents in his custody.

Habba insisted that she went to great lengths to comply with the subpoena, and even traveled to Florida to ask Trump if he had any documents responsive to the demand.

Habba noted that Trump doesn't use a computer at home or anywhere else, and that he doesn't send emails or text messages.

James is being sued by Trump in an effort to stop her investigation. He said her investigation and a parallel criminal probe overseen by the Manhattan District Attorney are a continuation of the greatest Witch Hunt of all time.

Despite a recent shakeup in the probe's leadership, Bragg said this month that the three-year-old criminal investigation he inherited in January is continuing without fear or favor. James is using her civil investigation to gain access to information that could be used against her in the criminal investigation, according to Trump's lawyers.

The district attorney has only charged the Trump Organization and Allen Weisselberg with tax fraud because of fringe benefits such as rent, car payments and school tuition. The company and Weisselberg have entered not guilty pleas.

The investigation is focusing on what the attorney general said was a pattern of misleading banks and tax authorities about the value of his properties.

The investigation was being hampered by the lack of evidence from the top of the organization, according to Andrew Amer.
