A California town has agreed to pay $150,000 to a couple who claim they were racially profiled by police officers in their own store.

Tiburon Police officers demanded that Yema Khalif put his key in the door or show identification to prove that he was the owner of the clothing store when he was setting up new inventory in August 2020.

The couple were pressured by the officers until the white neighbor confirmed he owned the store.

As part of the settlement, Khalif and his wife will sit on an advisory board that will vet candidates for the police department and the agency will bolster racial bias training.

Awash said during a press conference that the settlement was not just about him and Yema.

The only Black business owners in the town of Tiburon were sorting through inventory at 1 a.m. on August 21, 2020, when Tiburon Police Officer Isaac Madfes came to the door and asked them what they were doing.

A Tiburon police cruiser was parked in front of the store for 20 minutes after a couple and a friend noticed it three times.

Awash said the officer was aggressive, so he asked for a supervisor, who Madfes said was already on his way. The superior asked the couple about the photos on the wall in the store.

The street closes at 9 pm and there is never anyone in it.

This isn't regular business hours. There are no customers in there. We want to know if it's your store. I want to know what you are doing in the store at 1 o'clock in the morning.

The man fought off the man's demands for his identification.

I don't have to tell you anything. "If I tell you it's my store, then what?" asked Khalif, who is from Africa.

The sergeant insisted that he should show proof that it was the store of Khalif.

You don't sound like you're very grateful. You sound like you are very defensive.

"I don't have to prove my existence to you," he said.

I don't care what color the people are, they are all different in this store.

When a neighbor yelled from his balcony, Khalif reached for his key.

Ken Johnson told reporters that he saw the argument between Khalif and the officers, and he feared it would get worse.

"Thank you very much, that's all I need to know," he said before walking away.

The body camera and cellphone video of the interaction went viral. The Tiburon Police Chief Michael Cronin retired in September 2020 due to backlash over the incident. Tiburon Police officer Madfes is still on the job.

The couple agreed to a smaller settlement with the city after threatening to take it to court.

Tiburon Police officers must carry business cards with information on how to file a complaint. The San Francisco Chronicle reports that the department increased bias training from every five years to every two years.

Tiburon Mayor Jon Welner said that the changes proposed by Yema and Hawi will help make the town a leader in the areas of diversity, inclusion, and transparency.

Yema and Hawi were happy with the settlement. Some of the money from the settlement will be used to give scholarships to orphans in Africa. An officer from the city of Belvedere was dispatched to the store that night.

August 21, 2020, was traumatic for Awash, who is from Ethiopia.
