The Texas Attorney General filed a lawsuit on Friday to block the revocation of Title 42, a Trump-era policy that allowed Border Patrol to limit the number of asylum seekers due to Covid-19 health risks.

The lawsuit was filed in the Southern District of Texas in Victoria.

The state of Texas will face increased healthcare costs because of migrants with Covid who would have entered the country.

The suit comes two weeks after the Centers for Disease Control and Prevention announced the policy was no longer necessary.

The policy change was pushed back by several Democrats, including Gary Peters, Chris Coons and Joe Manchin.

A group of more than 20 states with Republican attorneys general asked a federal judge in Louisiana to block the repeal of Title 42. Several lawmakers, including moderate Democratic senators, introduced legislation two weeks ago that would delay the end of the public health policy for at least 60 days and require the Biden administration to come up with a plan for addressing spikes in migration. Some Senate Republicans said they would hold up Covid-19 funding if Title 42 was not extended. The White House believes that there will be an influx of migrants following the policy change. The repeal of the public health order is set to go into effect on May 23, but the Biden administration is considering a delay. The administration was taking a decision on whether or not to extend Title 42, the White House said on Thursday.

In the months leading up to the decision, a group of progressive Democrats had been pressing the Biden administration to remove Title 42. The members of Congress argued that the policy was inhumane and that the government was using public health measures to unfairly expel migrants.

The Texas Tribune reported that the state is trying to block the lifting of the Title 42 health rule.
