The exoneration of a man who had been wrongly imprisoned for 15 years was delayed because of a Detroit officer who claimed to have more information.

Terance Calhoun was moments from being cleared of his crimes and had his case thrown out when Judge Kelly Ramsey adjourned the hearing. She said she was approached by Detroit Police Officer Robert Kane, who had a binder of information that he believed to be relevant to the case and the release of Calhoun.

Kane testified at the preliminary examination.

In 2007, he was charged with multiple crimes, including the rape of a 13-year-old girl and the attempted sexual assault of another girl, and he pleaded no contest. He was sentenced to 17 years. The rediscovered rape kit excluded him from being the one who committed the crime.

The Conviction Integrity Unit of the Wayne County Prosecutor's Office asked a judge Friday afternoon to dismiss the case and clear the convictions. The request will be delayed pending a review of the materials.

Ramsey said that it was his responsibility to ensure that justice was done and that the court was aware of the need to ensure finality in its orders.

Ramsey said Kane presented her with a binder and told her to look at it before dismissing the case.

Oakland County lawyers charged in a debt-collection scheme are facing lawsuits.

The US Supreme Court rejected the murderer's argument to be freed.

Ramsey said that he did not want to continue this, but that this was the decision of the court. I do not know the solidity of that information. Whether or not the information that the officer may or may not have can be ignored to ensure that we arrive at an accurate conclusion.

The prosecutor's office, represented by the director of the Conviction Integrity Unit, and the attorney for the client, expressed their disbelief at the situation. The Detroit Police Department should not have gone behind the prosecutor and straight to the judge.

Newman apologized to Mr. Calhoun and his family who traveled from out of state to be here today to assist him and to all the defense attorneys because it happened this morning. It has never happened before. It is absolutely outrageous conduct on the part of the police officer.

In 2007, he was sentenced to life in prison for first-degree criminal sexual conduct, kidnapping, felony firearms and attempted kidnapping. He could be eligible for $50,000 from the state every year he is in prison because of a wrongful conviction.

Some people from Tenessee traveled to see him walk free from the prison. He said that the conviction should be thrown out.

The bottom line is we have a DNA exoneration here, and I believe the binder from Kane will not present any new information on the case.

The next hearing will be held on Wednesday at 1 p.m.
