The owner of a golf course in Virginia Beach and the city of Virginia Beach have reached a settlement over how to maintain the property.

A resident who has spoken out against the owner of the former Signature at West Neck golf course is upset by the terms of the agreement.

Tom Luckman, who lives in the Villages at West Neck, said it was a travesty.

W.C. Capital bought the golf course in 2020 after it closed three years before. The company submitted a proposal to the city to transform it into a residential community.

John McIntyre, the registered agent for W.C. Capital, has previously refused to reveal who the company's owner is. He could not be reached for comment.

The course is designed by Arnold Palmer. Many of the residents bought homes that overlooked the golf course.

When the golf course closed, the grounds became overgrown with weeds. The new owner and the city were the subject of complaints by Luckman and other residents.

Some residents took it upon themselves to mow the weeds in their backyards when they didn't get the results they were looking for.

Luckman and a few of his neighbors wrote letters to W.C. Capital about their concerns. There was a surprise in their backyards.

W.C. Capital put up a metal fence across the rear property line of three homes, including Luckman's. The fence stops at one yard of a resident who didn't raise concerns.

The city approved it despite Luckman trying to have it removed. The fence is still in the backyard of Luckman.

W.C. Capital was sued by Virginia Beach for not maintaining the golf course property. The lawsuit was scheduled for a bench trial this week, but both parties reached an agreement prior to the trial.

The agreement requires W.C. Capital to only landscape part of the property, and allows the company to create a buffer between the residential homes and the golf course. The company doesn't have to cut behind the residences.

W.C. Capital has to trim and maintain vegetation on the flat portions of the former fairways. According to the agreement, the company can build a fence to protect the property.

The company's attorneys successfully argued that the city code on excessive growth of weeds does not apply to parts of the former golf course property that are being used as an active farming operation.

W.C. Capital obtained a producers permit in 2020. There is a tree farm in the center of the course.

The resolution allowed some portion of the property to be maintained, in particular the high traffic areas.

W.C. Capital will be using security guards and electronic monitoring on the course, according to the joint statement.

The city can't inspect for possible violations. Inspectors will be observing from the public right of way.

He said that it is not a total solution.

Luckman is not happy with the outcome.

He said it was a shame that it got to this.
