The agency that enforces civil rights laws against workplace discrimination can now be added to the list of agencies that are investigating.

In a court filing on Monday, the automaker revealed that the US Equal Employment Opportunity Commission has an open investigation into it. There was a disclosure in a filing with the California Superior Court in Alameda County. Lawyers for the company asked a judge in California to stop the lawsuit from going forward.

The California Department of Fair Employment and Housing is overstepping its legal authority and using litigation as a bully to advance its turf war with the Equal Employment Opportunity Commission. When it filed a suit, it said it had received hundreds of complaints from workers and found evidence of discrimination at the factory.

The lawyers for the company noted that the agency didn't show worker complaints to the company until after the suit was filed.

In October of 2021, a jury ordered the company to pay $137 million in damages to a black former worker who accused the company of ignoring discrimination and racial abuse. The jury found that the judge had to reduce the damages to fifteen million dollars.

A former employee filed a lawsuit against the company for failing to investigate claims that an employee at the plant was referred to as a "hotspot".
