The federal mask mandate for air travel and public transportation was rebuked recently. A federal judge in Florida ruled that the Centers for Disease Control and Prevention's mandate is not legal.
The mask mandate exceeds the CDC's statutory authority and is in violation of the procedures required for agency rulemaking according to the US District Court Judge.
The court declared that the system does not allow agencies to act unlawfully even in pursuit of desirable ends.
When she was 33 years old, President Trump made her a lifetime appointment to the court. She was not qualified for the position at the time.

The order came as a surprise. The mask mandate was most recently extended until May 3 to give officials time to judge the danger of the BA.2 Omicron variant. The CDC said in February that most people in America don't need to wear masks indoors because community spread is low or medium risk.
There is no denying that a snap ruling like this is destined to cause confusion. Airline employees are struggling to deal with people who are unhappy with the current rules around masks.
Two Florida residents said masks increased their anxiety and panic attacks, and that's what led to the order. The case was brought forward by the Health Freedom Defense Fund.
