A federal judge threw out the federal government's mask mandate for airports, airplanes and other public transportation on Monday, ruling that the Centers for Disease Control and Prevention exceeded its authority by imposing the mask requirement days after it was extended.

The judge who was appointed by the former President Donald Trump declared the mask mandate to be invalid and sent it back to the CDC for further proceedings.

In July, the Health Freedom Defense Fund sued the CDC and federal officials over the mask requirement, asking the court to set it aside under the Administrative Procedure Act.

The Public Health Services Act of 1944 only allows the CDC to impose measures related to pest eradication, according to the ruling.

The CDC has not yet responded to a request for comment on the ruling and its practical implications.
