A Fort Worth 3-year-old who has spent most of her life at Cook Children's Medical Center is home with her mother after a lengthy court battle.

Tinslee Lewis has been in the intensive care unit at the Fort Worth hospital for most of her life. She was born premature and had a rare heart condition, and medical staff kept her alive through open heart surgery and a ventilator.

Tinslee's life-sustaining treatment was removed by the hospital ethics committee when she was 10 months old. Trinity Lewis had been fighting for the right to decide if her daughter lived or died.

Trinity Lewis posted on Facebook that she could not hold it in any longer. This journey has been very difficult and I am thankful that I was able to do everything I could to bring her home.

Lewis said Tinslee was doing well. She thanked her family, lawyers, various advocacy groups and Cook Children's Medical Center for their help in keeping her baby here.

Lewis said in her post that she was a "two carsEAT mom".

The post was shared to the Facebook page with the caption "Tinslee is home".

Tinslee Lewis has been the focus of a debate over who has the legal right to decide if a patient will continue receiving care. The Texas Advance Directives Act protects hospitals from lawsuits if they make a decision about patient care that is contrary to a family's wishes.

The trial for Tinslee was supposed to be held on January 25, but it was delayed. Both sides said in court documents that they were looking into alternatives outside of the court of law.

The Cook Children's Health Care System issued a statement in response to Tinslee returning home.

The medical teams at Cook Children have dedicated their lives to healing children, and go to great lengths to do what they believe in their hearts and minds to be the best decision for each and every patient.

Texas Right to Life supports Tinslee's case. The group said it is grateful for everyone who helped Tinslee get home.

Cook Children worked with the family to improve Tinslee's health so that she no longer needs a hospital setting for care.

Texas Right to Life said that Tinslee's case shows that families and hospitals can work together for the benefit of the patient.

Texas Right to Life has been an opponent of the Texas Advance Directives Act. If doctors determine care is futile or medically inappropriate, an ethics committee can choose to end treatment 10 days after a family is notified, unless the family can find another hospital to take the patient. The law allows physicians to make difficult but responsible decisions that families may not be able to accept. Hospitals don't have the authority to decide who dies and who lives.

History of Tinslee Lewis case

The ethics committee of Cook Children voted to end Tinslee's treatment. The hospital can end treatment for a patient if the care is deemed futile. Tinslee's treatment would only prolong her suffering according to the hospital.

Trinity Lewis was against the decision. She said that her daughter was not suffering and that she hoped she could improve. She and her attorneys filed for a restraining order against the hospital. The case has moved through multiple proceedings since the judge granted the injunction.

Tinslee's case went through the courts and each side appealed if the ruling was not in their favor. Tinslee could be taken off life support in January 2020 after an emotional hearing in the 48th District Court in Fort Worth. The Second Appellate District of Texas reversed the decision in July 2020.

The hospital's petition to take Tinslee off life support was rejected by both the Texas Supreme Court and the U.S. Supreme Court.

The case was returned to the lower court. Tinslee's treatment could have been ended if the 48th District Court had ruled in the hospital's favor. The future of the Texas Advance Directives Act would have been called into question if the court sided with Tinslee's mother.

The 48th District Court of Fort Worth was asked to expedite the court process and schedule a trial for July 2021. Lewis and her attorneys asked the courts for more time and a quicker trial because Tinslee's condition was improving.

Lewis said in court documents that her daughter was taking occupational therapy and had stopped taking pain medication.

The trial was supposed to be held in January, but it was delayed. The parties said in the status report that they were working to resolve the situation.
