According to two people familiar with the probe, a federal grand jury has heard testimony about Hunter Biden's income and payments while on the board of a Ukraine energy company.

It's not clear if he might be charged. The federal tax investigation into President Joe Biden's son remains active as prosecutors continue to examine foreign payments and other aspects of his finances.

A lawyer for Hunter Biden didn't return a phone message or email on Friday. A spokesman for the Justice Department did not want to comment on the investigation. A phone message was not returned by the office.

The people familiar with the investigation spoke to the AP on condition of anonymity.

If Republicans regain control of the House in the upcoming elections, it will cause a bigger political problem for the Biden administration because they will be able to use the investigation to attack the president. The focus of any investigations would be controlled by Republicans.

The White House was asked this week if it stood by the president's assertion in the 2020 debate that his son had not had unethical business dealings with Ukraine or China. Kate Bedingfield said yes.

The Justice Department has sought to assert its independence and has publicly stressed its willingness to let the facts and evidence guide its investigative and charging decisions.

Attorney General Garland has not commented on the investigation. The top federal prosecutor in Delaware, David Weiss, was retained by the Justice Department as a way to ensure continuity.

One month after the presidential election, Hunter Biden confirmed the existence of an investigation into his taxes. He said in a statement at the time that he was confident that a professional and objective review of these matters would demonstrate that he handled his affairs legally and appropriately.

The younger Biden was subpoenaed by the AP for information related to more than two dozen entities. He joined the board of Burisma when his father was vice president. Concerns were raised about a potential conflict of interest since elder Biden was involved in the U.S. policy towards Ukraine during the Obama administration.

There is no indication that the president is being scrutinized in the investigation into Hunter Biden. Biden has denied ever taking money from a foreign country, and has not discussed his son's international business dealings with him.

People familiar with the probe said witnesses have been questioned about payments Hunter Biden received while serving on the Burisma board.
