The high school track runner who was punched by another athlete in the middle of a race wants to press charges.

We previously reported that neither side wanted to press charges after the incident.

Nathan Carter, an attorney for the punched runner, says that is not the case.

Carter said that reports that his client refused to press charges was false.

The family of the victim wanted to press charges for the vicious attack and assault caught on video and witnessed by hundreds of people. The OCSD deputy told the family that if my client pressed charges then he would be arrested for battery.

The family chose not to press charges because of the threat.

The runner suffered a concussion as a result of the incident and Carter is looking into civil remedies against those responsible.

If the event hired proper officials, they could have stopped the CC athlete from standing on the track. The CC athlete could have been moved after the first lap incident. The CC athlete could have been moved before the second lap incident. They could have stopped the CC athlete before he sucker-punched my client.

They had many chances to prevent this and failed to do so.
