One of our employees is a Ukranian citizen and the other is on an apprenticeship program. We want to make sure they are able to live and work in the United States.

The most immediate concern is for the F-1 student whose OPT status is about to expire. We registered her in this year's H-1B lottery and are hoping she will be selected this week to apply.

Ukrainians are eligible for the program. Does that include F-1 students? Should our other Ukrainian employees apply for the same visa even though it is good for a few more years? What is the process for applying?

What is TPS?

To answer your questions about supporting Ukrainians in your team, I will give you a little background on the program. If there is an armed conflict or a natural disaster in a country, the Secretary of Homeland Security can extend the Temporary Protected Status (TPS) for that country. If a person is present in the U.S. on the effective designation date, they can stay and work in the United States.

For 18 months, Secretary Alejandro Mayorkas designated Ukraine for TPS. The last day to apply is August 28, 2022. Individuals may stay in the United States through September 1, 2023 if they are granted Temporary Protected Status. At that time, Mayorkas can decide whether to extend the current designation for Ukraine or redesignate it for those who arrived in the United States after March 1, 2022.

The countries that have designation are: Sudan, South Sudan, Syria, Venezuela, and Yemen.
