Justice Clarence Thomas took part in arguments at the Supreme Court via telephone rather than in person on Monday after a hospital stay.

At the beginning of the arguments, Chief Justice John Roberts said that the 73-year-old Thomas would be participating remotely this morning.

At one point in the case, Thomas made an analogy to when he drives his motor coach, asking several questions early in the case. Since the court started its term in the fall, other justices have occasionally participated in arguments remotely.

Thomas was hospitalized last week and missed arguments on Monday, Tuesday and Wednesday. Roberts said he would be involved in the cases argued using the briefs and transcript of the arguments.

Thomas was admitted to the hospital on March 18 with flu-like symptoms and was treated with antibiotics. The court said that Thomas did not have COVID-19. He had a booster shot, like the rest of the court. The court had said that Thomas would be released from the hospital on Monday or Tuesday, but he was not discharged until Friday.

The court didn't say why he was in the hospital longer than he thought, or what kind of infections he was treated for.

Since 1991, Thomas has been on the court.

When coronavirus case counts were high earlier this term, Justice Sonia Sotomayor participated remotely from her office, while Justice Brett Kavanaugh participated from his home after testing positive for COVID-19. The court described the bug as a stomach bug, but it was negative for carbon dioxide.

The court spent more than a year and a half hearing arguments remotely because of the Pandemic. The cases are still closed to the public while the justices and lawyers argue.
