Two years after attacking a 92-year-old Asian man with severe dementia at a 7-Eleven store in what was described as an anti-Asian attack, the man who attacked him won't be going to prison.

Jamie Bezanson, 52, was given a discharge and a one-year sentence by Judge Donna Senniw during his ruling at the Provincial Court of British Columbia on Monday.

Senniw ordered Bezanson not to make contact with the victim, Kaihong Kwong, and two others involved in the incident. The attacker has to pay 100 Canadian dollars and do 20 hours of community service.

Staff members at a 7-Eleven store were trying to help the elderly man when Bezanson began shouting anti-Asian remarks.

The attacker dragged Kwong by his arm and pushed him to the ground outside the store. The victim did not suffer serious injuries after hitting his head.

Multiple sources identified Bezanson as the suspect. He turned himself in after the police released the video. He was charged in July 2020.

The court said there was not enough evidence to call the incident a hate crime.

There was no reliable evidence that this was motivated by hate, and there was reliable evidence that it was not, according to Gordon S. Comer of the BC Prosecution Service.

The Canadian city of Vancouver was named the "Anti-Asian Hate Crime Capital of North America" in May of 2021.

Two surveys show that anti-Asian hate is still a problem in the city.
