The judge who ruled that the admissions policies at the prestigious northern Virginia magnet school were illegal denied a request to delay the implementation of his ruling.

Fairfax County Public Schools argued that they couldn't adjust their admissions policies with selection already underway, but they had enough time to come up with a back-up plan. If the admissions policy stays in place for a second year, he warned, there will be dire harm to the students who have been found to have been discriminated against.

The Thomas Jefferson High School for Science and Technology had its standardized admission test thrown out in 2020 in an attempt to increase racial diversity. The new system discriminated against Asian American applicants according to a group of parents.

The new policies included scrapping the standardized test and the $100 application fee, as well as setting aside slots at each of the county's middle schools, according to The Washington Post.

The changes increased the school's diversity. Asian American students made up 73 percent of the class of 2024, but only 54 percent of the class of 2025. Black and Hispanic representation increased from one percent to seven percent and from three percent to 11 percent, respectively. Fairfax County has a 20.1 percent Asian, 10.6 percent Black, and 16.5 percent Hispanic or Latino.

The Supreme Court said in January that it will hear challenges to university affirmative action policies that were brought by a conservative advocacy group.
