The judge sentenced Jussie to 150 days in jail for staging a hate crime in order to get attention. He defiantly maintained his innocence and said he could be killed in jail.

The hourslong hearing that ended with the sentence and post-hearing rant by the man who claimed he was the victim of a racist and homophobic attack was the culmination of three years of legal drama.

When offered the chance to make a statement before the judge announced the sentence, he said he was listening to his attorneys. After the judge issued his decision, he removed the face mask he wore to proclaim himself innocent.

"If I did this, it means that I stuck my fist in the fears of Black Americans in this country for over 400 years and the fears of the LGBT community," he said, standing up at the defense table. I'm not suicidal. I didn't do it to myself when I went in there. You must all know that.

As he was being led out of the courtroom, he shouted again.

He yelled, raising his fist, that he was innocent.

He was sentenced to 30 months of felony probation, with 150 days served in the Cook County Jail, and was ordered to pay a $25,000 fine and $120,106 in restitution to the city of Chicago.

Linn was asked to include an appropriate amount of prison time when sentencing the actor for disorderly conduct.

His conduct will discourage others who are victims of hate crimes from coming forward.

Attorneys for the actor wanted the judge to limit the sentence to community service, arguing that he had already been punished by the criminal justice system.

Those comments were echoed by family members.

His grandmother told the court that he should not be sent to prison. If you do, send me along with him, OK?

The NAACP president, LaTanya and Samuel L. Jackson, and other supporters wrote letters to Linn asking for her to consider the case.

Several supporters spoke about how worried they were about his race, sexual orientation and Jewish heritage being put at risk in prison.

Linn said he considered the requests for mercy, along with the financial support of social justice organizations. Linn said that he was astounded by the actions of the actor given his family background and ties to social justice work.

Linn said that the damage you have done to yourself is beyond what can be done to him.

Nenye Uche said he will ask the jail to keep him in protective custody and that he will appeal both the verdict and the judge's sentence.

Uche did not expect Linn to include jail time.

Uche told reporters after the hearing that he was a Black guy.

A spokesman for the Cook County Sheriff's Office said that a comprehensive medical, mental health and security assessment is a routine process.

Linn rejected a motion from the defense to overturn the jury's verdict on legal grounds before the sentencing portion of the hearing began. Judges rarely grant such motions.

Each of the five felony counts of disorderly conduct could have led to three years in prison. He was found not guilty on a sixth count.

Experts didn't expect him to be sent to prison because he has no criminal history and the conviction is for a low-level crime.

The sentencing on Thursday is the latest chapter in a criminal case that made international headlines when it was reported that two men wearing ski masks beat him, and yelled racial and homophobic slurs at him on a dark Chicago street.

Cook County State's Attorney Kim Foxx had come under fire for her office dropping charges against the actor. On Thursday, Foxx blasted a "relentless, organized and effective" push to pursue Smollett while other serious crimes were unresolved.

In a column published by the Chicago Sun-Times, Foxx said that they shouldn't bully prosecutors and circumvent the judicial process to get it changed.

Special prosecutors were appointed to lead the second case. Two brothers testified that they were paid to carry out the attack and that they were given money for the ski masks and rope. The prosecutors said he yelled "MAGA country," a reference to Donald Trump's presidential campaign slogan.

The men who worked on the show were not the ones who attacked him, and he did not know they were there.

The public was allowed to see and hear the first time that J.Smoltz spoke in court, because Linn agreed to let photographers and a television camera inside.
