The Texas court tossed out the state's appeal of an order preventing child welfare officials from investigating the parents of a trans teenager.

The Texas 3rd Court of Appeals dismissed Attorney General Ken Paxton's appeal of a judge's temporary order that halted the investigation into the parents of a 16-year-old girl.

The judge's temporary order was not appealable.

The parents sued over the investigation and the governor ordered officials to look into reports of abuse. The first report of parents being investigated after Abbott's directive was the lawsuit.

The appeals court decision clears the way for the judge to hold a hearing on whether to issue a broader temporary order blocking enforcement of Abbott's directive.

At a court hearing last week, an attorney for the parents said he had heard of at least two other families facing abuse investigations by the DFPS. The 19th, a nonprofit news organization, reported Wednesday that a Dallas-area family said the department is investigating them.
