A husband and wife died from a gas leak inside a company-owned facility in West Texas as their children waited for them in a car outside, according to the Department of Justice.

The charges are related to the fatal incident on Oct. 26, authorities said in a news release.

Jacob Dean, an employee of Aghorn Operating Inc., received a call to check on the pump house.

He didn't return home when he was supposed to, and he didn't answer calls from his wife. She went to the pump house to check on her husband, and brought their children along for the ride.

She went in to find her husband while the kids waited in the car.

A pump failure caused a leak of produced water containing hydrogen sulfide, the release said.

Oil and gas produced water can contain harmful chemicals.

The release said that Jacob had been overcome by hydrogen sulfide in the pump house, and when she arrived at the station, she exited the vehicle and proceeded to the pump house, where she too was overcome by the gas.

Aghorn was aware that its produced water contained high amounts of H2S as well as the deadly nature of the gas, according to an indictment.

Aghorn Operating Inc. declined to comment when contacted by phone.

According to the CDC, hydrogen sulfide gas has a strong odor of rotten eggs. If the concentration is high, people could collapse within minutes or experience a collapse within 1 to 2 breaths.

According to federal officials, Aghorn Operating Inc. and Vice President Trent Day are accused of obstruction of justice and violating the Clean Air Act.

The Safe Drinking Water Act and making false statements to state officials regarding the mechanical integrity of Aghorn injection well are also charged with Aghorn, Day, and another company.
