Tarrio ordered the Proud Boys to storm the Capitol and later took credit for the attack on social media.

Tarrio was arrested on January 4 for stealing and burning a Black Lives Matter flag from a historic D.C. church.

Tarrio is accused of obstruction of an official proceeding, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and two counts of assault, resisting or obstructing certain officers.

Tarrio has been subpoenaed by the House select committee probing the Capitol riot, as well as figures like the leader of the Oath Keepers and the head of the 1st Amendment Praetorian. The maximum penalty for seditious conspiracy is 20 years in prison, which is what Rhodes was indicted for in January. Tarrio was released from jail in D.C. in January after serving just over four months for destroying the Black Lives Matter flag. Less than a week after Oath Keepers member Joshua James pleaded guilty to seditious conspiracy, he was indicted.
