MyPillow CEO Mike Lindell tried to get the defamation lawsuit against him thrown out.
The judgement was filed on Tuesday by District Judge Carl J. Nichols. The judge wrote that the litigation against MyPillow would continue.
According to the filing, MyPillow has not made a serious argument that a court is required at the motion to dismiss stage in a defamation case, to consider and weigh factual materials outside the pleadings and relied on by the defendants.
The questions raised by the team were far from exceptional according to the judge.
The pillow company and its owner were sued by the company for allegedly damaging them when he pushed false conspiracy theories about the company.
Both Rudy Giuliani and Sidney Powell were sued at the same time for promoting baseless theories that the election was stolen from Trump for Biden.
The three separate lawsuits were consolidated into one case and will move to trial in tandem.
Lawyers for Lindell have avoided meetings for the defamation lawsuit and refused to give discovery material. In January, he told Insider that his team was waiting to see if their appeal would be successful.
In February, the legal teams for the two companies said they had no intention of resolving their cases.
The voting company Smartmatic is accusing Lindell of being crazy like a fox and of scheming the fires of the party divide for the noble purpose of selling.
He has countersued the public-relations company Hamilton Place Strategies.
He told Insider that he was going to go ahead with his fight against the companies after his appeal was dismissed.

He has been working on a class-action lawsuit for over five months, and claims that he has amassed testimonies from hundreds of county clerks and Commissioners against voting technology companies.
He said that the lawsuit would likely be filed within the next two weeks and that he wanted to get more people in it. He hoped that the election technology company would also file a lawsuit against him.

According to a separate filing on Tuesday, Nichols ordered that the defamation lawsuit against Giuliani and Powell proceed in full. The discovery is scheduled to be completed by January 12, 2023.
