The owner of the restaurant chain, who was charged with fraud by the Securities and Exchange Commission last year, is facing claims of back rent.

A court summons, order from the sheriff's office, and other documents were taped to the door of the Midtown eatery as it was closed on Monday.

Neither the attorney for Apple Colorado nor the building's owner responded to emails from the Coloradoan as of 1 p.m. Wednesday. The restaurant's phone calls went unanswered Monday and Wednesday.

Pinocchios in Midtown opened at the start of 2020

According to court documents obtained by the Coloradoan, Pinocchios Incredible Italian opened its doors in January 2020 after subleasing the former Applebee's building in 2019.

The Fort Collins restaurant was the sixth location of Pinocchios Incredible Italian.

There are three current locations of Pinocchios Incredible Italian on the website. A photograph sent to the Coloradoan shows a notice on the door of one of its former locations.

The former Niwot location of the restaurant has been reopened as Cimmini's, according to the Coloradoan.

The DeBoards decided to go independent and change the restaurant's name in an effort to separate themselves from Vick, who just wasn't holding up her end of the bargain when it came to the franchise.

The liquor license in Niwot expired in October of 2021, but the DeBoards took over the license and applied for a transfer of ownership to align with the restaurant.

The couple's final straw came last October when the SEC charged a Colorado investment adviser with fraudulently raising $3.2 million from investors using a pooled investment fund she owned, according to the SEC.

The restaurant was reopened by the DeBoards within a month.

A civil penalty and interest of more than one million dollars were paid back by Vick after he agreed to do so. She will not be allowed to act as an officer or director of any private company as part of her settlement.

Allegations against Pinocchios detailed

In Fort Collins, Apple Colorado claims that Pinocchios Incredible Italian failed to pay its full rent for a number of months.

After reaching an agreement to pay back rent in February 2021, the restaurant's account once again became delinquent when it failed to pay its full rent from July 1, 2021, through the rest of the year. According to court documents, it failed to pay property taxes.

The Fort Collins area will see 35 openings and 12 closings in the year 2021.
