This time, Musk is accusing the federal government of leaking.
Musk's attorney accused the commission of leaking information to retaliate against him after he claimed that the SEC was trying to harass him.
The alleged campaign began after the SEC charged Musk with misleading investors after he said he would take the company private. The case was settled last year after Musk andTesla paid $20 million each in fines, but new reporting about the commission subpoenaing the CEO in recent months has reignited the debacle.
The most recent letters were written by Alex Spiro and addressed to US District Judge Alison Nathan, who presided over the settlement. Spiro addressed the letters to the judge to try and broker a meeting between the SEC and Musk.
CNBC reported last week that the SEC subpoenaed him in November of 2021.
Musk's attorney wrote to Judge Nathan suggesting that the commission was investigating his client for criticism of the government. The commission said in its own statements to CNBC that it was moving forward with the difficult task and would submit a proposal.
Musk's attorney has not given any evidence to support the accusation that the government is trying to retaliate against him. If the SEC charges him again, he will not go into another settlement.
