Scott Brady, who served as a US attorney in Pennsylvania under the Trump administration, behaved in a way that was unbecoming of a U.S. Attorney.

The Justice Department's inspector general released a lightly redacted report on Brady's actions on Friday in response to a request under the Freedom of Information Act. Brady's actions did not violate any specific policy, regulation, or guideline according to the watchdog office. The report was a public rebuke.

Brady stepped down as the US attorney for the Western District of Pennsylvania in February 2021. The fact that he had left the department meant there wasn't any other action the DOJ could have taken. He worked at Jones Day before Donald Trump nominated him. He didn't return a request for comment.

The events that led to the complaint against Brady began the week after the election. Attorney general Bill Barr issued a memo that gave federal prosecutors more authority to investigate voter fraud allegations. The move was criticized as a joke because of Trump's refusal to accept that he lost the White House and his continued efforts to promote the lie that the election was stolen. The head of the DOJ office that investigates election-related crimes resigned in protest.

A group of 16 assistant US attorneys who were serving terms as the district election officer for their office signed a letter to Barr asking him to withdraw the Nov. 9 memo. One of the election officers in Brady's office was included in the letter, but the attorney's name is redacted in the report. The attorney told one person in their office that they were thinking about signing the letter, but no one else, including Brady.

The letter to Barr was reported by various news outlets. According to the inspector general report, an official in the Executive Office for the United States Attorneys sent a message to the US attorneys whose staff had signed the letter, including Brady. The message warned that the letter could potentially cause First Amendment speech protections and urged the US attorneys to take no action.

Brady asked the attorney in his office if they believed they could follow Barr, and if it would be okay if he asked them. Brady could have a discussion with the attorney, but the DOJ official warned that removing them from the position could open you up to a retaliation claim.

Brady spoke at a press conference about a case his office was handling. A reporter asked if his office was investigating voter fraud. Brady replied.

I can't comment on any existing investigations. One of our two district election officers, who was married to the former chief of staff of Eric Holder, did sign on to that, but did not mention it to his fellow district election officer.

The assistant US attorney told the inspector general's office they were shocked by Brady's comments and that the reference to his spouse was inappropriate. He told the inspector general's office that he had been trying to communicate that the letter wasn't signed by his office. I could have made that point differently, but I defended it as relevant.

The inspector general's office found thatBrady's derogatory public remarks about an AUSA in his office were meant to undermine the professional reputation of the AUSA.

The attorney in Brady's office didn't have to tell top officials about their intent to sign the letter to Barr, and they didn't violate any ethical obligations.

Brady was chastised by the office for his attempt to downplay the seriousness of his conduct, and for telling the OIG that he did not find his conduct serious. Brady acknowledged that his remarks wereill-advised and that he should have taken a different approach to the reporter's question after being given an opportunity to review the draft report.
