Unless Amazon settles a case with a fired worker, the National Labor Relations Board will issue a formal complaint.

The National Labor Relations Board is going to issue a complaint against Amazon if the company doesn't settle the case first. The issue is whether Smith was fired for trying to organize.

If the case doesn't settle, Kathy Drew King, the regional director of the National Labor Relations Board, will issue a complaint if the allegations against Smith are proven to be true. Blado said that the discharge would be due to union and other protected activities.

Amazon did not reply to a request for comment.

The ALU is waiting for a hearing on its petition to hold a union election at four Amazon warehouses. Smith was fired from his job at one of the Staten Island warehouses and has been homeless since. It is not yet clear if the National Labor Relations Board will restore workers fired for organizing.

Amazon was ordered to redo a union election at its warehouse in Alabama after the National Labor Relations Board found the company interfered in the first election. The redo will begin on February 4th.
