The lawsuit said that his sister was in Washington, DC, during the riot, but never entered the Capitol.

The family of a US Marine who was killed in a suicide bombing in Afghanistan over the summer has filed a $25 million defamation lawsuit against Alec Baldwin, saying the actor accused them of being insurrectionists after he learned the Marine's sister was in Washington, DC.

Baldwin's comments about the family on the social-media platform were false, outrageous, defamatory, irresponsible, and caused severe emotional distress, according to the lawsuit.

13 US service members were killed in the attack at the Kabul airport on August 26 as troops withdrew from Afghanistan.

The lawsuit was filed on Monday in the US District Court for the District of Wyoming by the sisters and widow of the man.

The court papers said that Baldwin donated $5,000 to the Marine's widow and her newborn daughter as a tribute to a fallen soldier.

On January 3, Baldwin posted a photo of a crowd of pro-Trump protesters in front of the Washington Monument, in anticipation of the anniversary of the Capitol riot.

Are you the same woman that I sent money to for your sister's husband who was killed in Afghanistan? Baldwin commented on Roice's post.

Baldwin accused her of being an "insurrectionist" and told her to "own it," according to the suit.

The lawsuit said that Baldwin sent money to Roice for her brother's service to the country, but didn't know he was a January 6th rioter.

She said that testing is legal in the country and that she had a meeting with the FBI. Have a nice day!

She attended the rally in a peaceful, law-abiding manner, according to the lawsuit.

The suit said that neither Jiennah nor Cheyenne were in Washington on the day of the Capitol riot.

Baldwin messaged Roice: "I reposted your photo." Good luck. He shared a post on his account that said that people were at the Capitol peacefully and that he donated money to a soldier who died in Afghanistan. Then I find this. He wrote that truth is stranger than fiction.

An attorney for Baldwin didn't respond to a request for comment on Wednesday.

Roice got hostile, aggressive, hate mail from Baldwin's followers within minutes of the post, including one message telling her to "get raped and die," according to the lawsuit.
