A 35-year-old American law has been used by the U.S. federal agencies to secretly track users of the messaging service. In Ohio, a government application shows that the Drug Enforcement Administration demanded that the Facebook-owned messaging company track seven users based in China and Macau. The application shows that the Drug Enforcement Administration didn't know the identities of any of the targets, but they were told to watch the numbers and addresses of the targeted users. Under the 1986 Pen Register Act, the use of a pen register and end-to-end encryption is what is used for this type of snooping.

Over the last two years, law enforcement in the U.S. has ordered tech companies to install pen register without showing any probable cause. The government order to trace Chinese users came with a statement that the Justice Department only needed to provide three elements to justify the tracking. The identity of the attorney or the law enforcement officer making the application, the identity of the agency making the application, and a certification from the applicants that the information likely to be obtained is relevant to an ongoing criminal investigation are included. Federal law does not require that an application for an order authorizing the installation and use of a pen register and a trap and trace device specify any facts, according to the government.
