The FBI Knew Exactly What Its “Double Agent” Was Doing, Says A Defendant In The Michigan Kidnapping Case



An attorney for one of the defendants in the alleged plot to kidnap Michigan Gov. has launched a direct attack on the credibility of the prosecution.

Stephen Robeson was accused by prosecutors of disobeying FBI rules and trying to undermine the investigation into an alleged conspiracy to kidnap and try a woman for treason. They claimed that Robeson used charity funds to purchase weapons for attacks.

The FBI was aware that Robeson had made such offers, according to a new filing by the attorney for Adam Fox. The filing includes a transcript of an August 2020 recording in which another person tells Fox that the charity was used to purchase weapons.

The FBI had an intimate knowledge and control of Robeson's activities, and the government tried to minimize his involvement.

The FBI referred inquiries to the Justice Department. The US Attorney's Office in the Western District of Michigan does not discuss criminal matters.

The five men facing federal trial in the case claim that they were entrapped by the government, and that they were particularly targeted by Robeson and another FBI mole. The FBI and its operatives were the only ones who planned to kidnap anyone, according to the defendants.

The prosecutors argued that the defendants were more likely to take violent action against the governor because of the strict COVID policies she had implemented. They have asked the judge to limit the evidence that can be admitted into the trial.

They have argued that many of the statements made by the men during the investigation should not be allowed as evidence, and that they will not call three lead FBI agents in the case. They said last week that statements by Robeson should be kept out of the courtroom.

The FBI terminated Robeson as a confidential Informant three weeks after the defendants in the Michigan case were arrested. The new evidence shows that the FBI paid him $19,328.79 for his work, and that he helped organize at least four events that the government highlighted as critical in the evolution of the alleged conspiracy.

While working on the case, Robeson obtained a.50 caliber rifle despite the prohibitions on gun ownership by people with felony convictions. He agreed to a plea deal in September after being indicted on a gun charge last March. It was an extremely favorable deal for him, if prosecutors knew he had been secretly working against the interests of the government.

Robeson was charged again in Wisconsin state court last month. He is alleged to have cheated a couple out of an SUV by telling them it was going to a charity he controlled. Robeson kept the vehicle for his own use and there was no charity. The FBI agents overheard a conversation about Robeson's use of a charity to acquire weaponry, and that is alleged to have taken place during the same month that the fraud took place.

Robeson undertook a number of unauthorized acts, including offering the charity funds, obtaining weapons, and offering to use a drone to aid in acts of terrorism, according to prosecutors. He failed to record certain events he was supposed to be telling the FBI about, attempted to destroy other evidence, and warned at least one person that he had been approached by the government.

Prosecutors argued that his statements and actions while working for the FBI should be excluded from the case.

Gibbons challenged the argument in Tuesday's filing. The Government relied on a specific group of agents and confidential informants from October to October of 2020 in establishing its case against these defendants. The Government is trying to distance itself from the same group agents and people who are going to be in a jury trial.

A hearing on what evidence will be admitted at trial is scheduled for next Tuesday.
