There were a number of underlying health conditions that were present when he was tasered.
Six months after a police officer was jailed for manslaughter for kicking a football player in the head, police apologized to the family.
"I am deeply sorry," said Mills.
She wrote that a police uniform doesn't give officers immunity to act in ways they shouldn't.
The first death in custody in 30 years happened with PC Benjamin Monk.
The family of Mr Atkinson, a former premier league star with Aston Villa, said the case showed the need for change in the way black people are treated by the police and the criminal justice system.
The legal proceedings ended three months after Ms Mills took over as West Mercia Police chief.
She said in her letter to the family that she had an obligation to acknowledge and accept the fact that Mr Atkinson's human rights had been violated.
"Ben Monk's conduct was in direct contradiction to the standards and behavior of the policing service, and understandably undermined public confidence," she said.
I am deeply sorry for the devastating impact the actions of a West Mercia officer has had on you and your family, and I extend my deepest sympathies to you all," the chief constable said.
Ms Mills said she was sorry for the family and that the delays in the trial had added to their grief.
You have shown great strength and dignity over the past five years.

PC Monk was not sacked earlier.
Mr Atkinson died in hospital in 2016 after he was arrested outside his father's home in Telford, Shropshire, because he was suffering from a serious illness which had affected his physical and mental health.
The former footballer was in the midst of a mental breakdown and had been shouting outside his father's house that he was the Messiah.
Monk used his taser on the 48-year-old for 33 seconds and kicked him as he lay in the street, hard enough to leave bootlace prints on his forehead. The judge at Monk's trial described his actions as excessive force.
The police watchdog said it was the first time in three decades that a British officer had been convicted of manslaughter for their actions in the course of their duties.
10 officers have faced murder or manslaughter charges but have been acquitted or their cases have collapsed.

He was known for his skills and sense of humor. He was a well-liked player by his manager.
After graduating from high school in 1983, Dalian began his football career at Ipswich Town, before moving on to play for Real Sociedad and Wednesday.
He made 85 appearances and scored 25 goals in the year 1991. He is often remembered for the Match of the Day goal of the season in 1992-93, when he dribbled the ball from deep in his own half and delicately chipping it over the Wimbledon goalkeeper from the edge of the penalty area.
His family said he struggled to come to terms with a serious illness affecting his kidneys in the last six months of his life.
Kate Maynard, a lawyer for the family, said in a statement that the apology is welcome.
She said that the acknowledgement that a police uniform does not grant immunity is relevant in a year that has seen other terrible examples of police violence.
It is hoped that this will serve as a deterrent, and also embolden those who seek police accountability, with the first conviction of a serving police officer on a manslaughter charge connected with his policing duties in over 30 years.
West Mercia Police's Assistant Chief Constable Rachel Jones apologized to the family of Mr. Atkinson in a letter, the first time the force has formally apologized for the killing.
Monk's lawyers said at his trial that his actions for 59 seconds during the confrontation with Mr Atkinson were out of character with his police career, and that he had no intention of killing or injuring Mr. Atkinson.
The court heard that he had been warned by West Mercia Police for breaching standards of honesty and integrity by failing to disclose cautions for theft and drunkenness before he joined the force.
Monk was dismissed after his conviction.
