Jurors in Elizabeth Holmes criminal trial are handed case and begin deliberations as arguments conclude

The 12 jurors who will decide the fate of Theranos founder ElizabethHolmes are left to consider the testimony from 31 witnesses over three months as they begin their deliberations.

The case was presented to the jury. Judge Edward Davila finished reading the instructions. The founder of a blood-testing company, who dropped out of the school to build it, is charged with nine counts of wire fraud and two counts of conspiracy to commit wire fraud. She could face 20 years in prison if convicted. She denied the charges.

Kevin Downey made his final plea on Friday, arguing that his client should be acquitted.

The first sign of trouble is when crooks cash out, criminals cover up and rats flee a sinking ship. She did not do that.

Downey said that Theranos founder, now 37, dedicated her life to building the company and never intended to cheat investors. He said that the success of Theranos was the main reason forHolmes' wealth.

Downey said that she went down with the ship. That is who this woman is.

Downey spent three hours trying to get rid of the government's case. He said that the company didn't lie to investors.

Murdoch, Don Lucas and the family of Betsy DeVos are just a few of the high-profile investors that Theranos raised $945 million from over the course of a decade. Some of those investors were government witnesses.

People lost money. Downey said that he didn't mince words about that. Ms.Holmes did not intend for people to lose money. That is a failure on her part.

Downey said that the investors knew it was a risk and they knew it was a new venture.

The courtroom in San Jose was empty on Friday. Her parents and partner were by her side.

After the defense wrapped up its closing argument, the prosecution came back with a rebuttal and put the spotlight back on the level of control she had over her company.

John Bostic said that the disease that plagued Theranos wasn't a lack of effort, but a lack of honesty. It was at the top, not at the ground level.

Bostic said that the company shouldn't be confused with a failed company.

Bostic said they admire people who set ambitious goals. The case went bad for Theranos and Ms.Holmes when she decided to break the law instead of accepting failure.

In order for the jury to convict, they must unanimously agree that the founder of a company that was once hailed as the youngest self-made female billionaire intended to cheat investors and patients.

Danny Cevallos, an NBC News legal analyst, said the jury has a lot of evidence to consider, given the number of witnesses who took the stand.

Cevallos said that the jury has a lot of evidence to go through if they want to. When the door shuts, they may look at each other and say, "None of us believe a word she said."

The defense did not mention the ex-boyfriend of the business partner in their closing argument. Balwani was the center of the testimony. She told the jury that Balwani abused her. She said that he was in charge of the finances and the Theranos lab.

Balwani is set to stand trial early next year. He pleaded not guilty.

Downey didn't say Balwani's name on Friday.

Cevallos said that it could hurt her. I think jurors will ask each other why they didn't mention the trauma from Balwani in closing, if it was so important to them.

Bostic came back to the topic in his rebuttal. The jury should not be swayed by the abuse testimony.

Bostic said that in the absence of any evidence linking that experience to the charged conduct, you should put it out of your mind. Ms.Holmes did not need Mr Balwani's encouragement to be deceptive.
