Prince Andrew’s Lawyer Argues Virginia Giuffre Was Old Enough to Consent Under New York Law

Virginia Roberts Giuffre claims she was forced to have sex with Prince Andrew, and he is trying to throw out the civil case she brought against him.

Andrew asked the presiding judge to keep some of his responses to Giuffre under seal.

Andrew asked the judge to dismiss Giuffre's complaint because the New York's Child Victims Act, which she is suing him under, is flawed because it doesn't consider those under the age of 18 as consenting adults. Giuffre claims that she was forced to have sex with the prince multiple times when she was 17 years old.

Andrew claims to have never met Giuffre, despite a notorious photograph of him with his arm around her bare midriff. Jeffrey Epstein, who died in a jail house suicide in 2019, took a photograph of Ghislaine in the background at her London apartment.

Andrew's allies have previously planted stories in the press saying he believes the picture is a fake, a claim which has been met with stunned disbelief by his critics.

The Child Victims Act is not a reasonable mechanism to address the injustice of child sexual abuse in New York, according to a new filing from Andrew's legal team.

Giuffre was between the ages of seventeen and eighteen, and Andrew thinks that the issue of consent is not settled.

Andrew's legal team acknowledged in the paperwork that it would be possible to prove lack of consent by showing evidence of anmplied threat, but it would be difficult to prove as memories fade.

The filing states that the only witnesses to the alleged threats are the accused and Giuffre herself.

The Times reports that Andrew wants to be protected from legal action by Giuffre under the terms of a settlement she made with Epstein in 2009.
