According to court documents, a federal judge dismissed the defamation lawsuit against the Daily Mail on Friday.
The Mail was sued for defamation by a man who claimed that he and a "30 Rock" actress had a secret affair.
The British tabloid had reported that an anonymous friend tipped them off that Krakowski was dating Lindell. After the article was published, both Krakowski and Lindell denied the story, and in his suit, he claimed that he had never heard of Krakowski.
The Mail had as part of their defense in the Friday ruling by the US District Court Judge.
Crotty wrote that dating an actress would not cause "public hatred,shame, ridicule, or any similar feeling towards Lindell."
The story caused personal harm and emotional distress to Lindell because it claimed that he sent Krakowski alcohol.
In his lawsuit, he said the story has hurt his reputation and ability to provide services, and that he created the Lindell Recovery Network because of it.
Mr. Lindell is a recovering alcoholic and addicted to drugs who frequently writes and speaks about his spiritual triumph over substance abuse.
According to the ruling, Crotty found that the claims of Lindell were insufficient to qualify as defamation.
Crotty wrote that the purchase of alcohol is a legal and ordinary act. If depictions of alcohol consumption, such as underaged drinking or alcoholism, fail to qualify as defamation in New York courts, no reasonable reader could find it offensive to exchange champagne or other bottles of liquor as gifts between romantic partners.
The judge said that he would not test the statements by asking how they would be understood by a group of evangelical Christian readers.
Insider reached out to the attorneys for the Daily Mail. A representative for Krakowski didn't respond to Insider's request for comment on the dismissal.
