Matthew T. Schelp agreed with the states that the Centers for Medicare and Medicaid Services did not have the authority to issue its vaccine mandate without congressional approval.

The judge ruled that the federal government was incorrect in claiming that the mandate is an emergency measure because it was not imposed until months after the vaccine became available.
As the litigation moves forward, the injunction only applies to Alaska, Arkansas, Iowa, Kansas, Missouri, Nebraska, New Hampshire, North Dakota, South Dakota and Wyoming.
A federal judge denied an injunction against the vaccine mandate in Florida last week, and a separate legal challenge brought by over a dozen additional states is still pending.
