A lawyer for the families said Thursday that they have not reached a settlement with the US government.
Attorney Lee Gelernt of the American Civil Liberties Union would not discuss details of the talks or confirm a previously reported settlement proposal of several hundred thousand dollars to each affected person. If there is no agreement to end the litigation, a trial featuring parents separated from their children as young as six months as witnesses is possible.
Gelernt told reporters that there was no deal on the table and that there was no time frame.
The settlement talks have become a new line of attack for Biden administration critics who want to tie the issue to the increasing number of migrants crossing the U.S.-Mexico border. Alejandro Mayorkas was grilled by Republicans when he appeared before the Senate Judiciary Committee.

Biden said a payment of about $450,000 per person was not going to happen when he was asked about the amount. He said he supported a settlement without specifying an amount.

The amount of the settlement and legal status of the families misses the point according to migrant advocates. Conchita Cruz, co-executive director of the Asylum Seeker Advocacy Project, said that the issue was whether the country was okay with ripping babies out of their parents.
Critics claim that many of the separated families were not entering the country illegally because they were presenting themselves to authorities to seek asylum, but Gelernt noted in the call that this was not the case. Even non-citizens can file a lawsuit against the U.S. government.
He said that lawyers always settle cases because it's in their financial interest.
The advocates gave a sense of what a trial might look like, and brought a woman to the call who had her son taken from her as she sought asylum. She said the boy showed signs of psychological trauma after being separated for 2 1/2 years.
She said that they live in fear of being separated a day after being together. I could not imagine living through this again.
