Loudoun County prosecutor who sought to jail father of girl allegedly raped at school tied to Soros, McAuliffe

Loudoun County's prosecutor sought jail time for a father who was accused of sexually assaulting his daughter in school bathrooms. He also has connections to progressive megadonor George Soros as well as Democratic Virginia governor nominee Terry McAuliffe.
Loudoun County Commonwealth’s Attorney Buta Bibiraj was described by The Daily Wire in an explosive report as the "progressive” elected county prosecutor. She ran on the platform of ending mass incarceration, but she still sought jail time for disorderly behavior and resisting arrest against Scott Smith.

Smith was taken into custody at a June 22 school board meeting, several weeks after Smith claims that his daughter was raped in a school restroom by a gender-fluid student. In that case, the 15-year-old student was charged with two counts each of forcible sexual abuse and later arrested. The ankle monitor was fitted and he was transferred to Ashburn school, where he was charged with another assault on a female student in October.

Fox 5 reported that Biberaj explained Friday that the decision to transfer the student was made because he did not have any prior history of such behavior. She asked for patience and to refrain from judging until all facts are known.

Smith's attorney announced plans to sue school district for its handling of this case and his arrest at the school board meeting. Smith was sentenced to 10 days imprisonment, with all suspended sentences, subject to a year of good conduct.

According to The Daily Wire Biberaj appeared at court to prosecute Smith personally, even though he knew the details of the case that involved his daughter. Elizabeth Lancaster, Smith's attorney, told The Daily Wire that she has known Biberaj "years" but was shocked to hear that the charges against Smith were not dropped.

Lancaster stated that the idea that they would seek jail time is absurd. She said that she has never seen it happen in her 15-years of experience. Given her social justice reforms, it was amazing to me that she believed this was a person we should put in a prison cell. It was amazing."

According to Daily Wires, Biberaj's motives in prosecuting the case may be political. She claims she is known for her willingness to give leniency and other alternatives to imprisonment in other cases. After an accused husband-beater who was on bond for allegedly murdering his wife with a knife, Biberaj came under fire earlier in the month for dismissing hundreds of domestic violence cases. Washington Free Beacon reported that Virginians for Safe Communities, an advocacy group, is leading a recall campaign against Biberaj in response to this case.

Fox News asked Biberaj for comment but he did not respond immediately.

Biberaj was one among several Soros-backed prosecutors who were elected in Northern Virginia in 2019. Her campaign received over $860,000 from Soros’ Justice and Public Safety PAC. Biberaj is an advocate for criminal reform and a member of the Virginia Progressive Prosecutors for Justice group, which advocates for abolishing mandatory minimum sentences and cash bail.

Biberaj, who is also an ally of McAuliffe and reportedly accepted $250,000 from Soros to support his campaign in August, is also close to McAuliffe. Biberaj, a former Democratic governor, has spoken out in praise of McAuliffe, describing him as "part the progress" Virginia needs. He was seen with McAuliffe at an event in Leesburg on Oct. 2.

McAuliffe is running against Glenn Youngkin, a Republican gubernatorial candidate. He has previously praised Biberaj for being a "champion" of criminal justice reform. He supported her and ran for her in 2019, claiming that she would bring about "real criminal justice reform" in Virginia.

Fox News requested McAuliffes campaign to comment but McAuliffes did not respond immediately.
