In the wake of Texas' near-total ban of abortions, the Department of Justice has committed to uphold a federal law protecting individuals who seek reproductive health services.
Merrick Garland, US Attorney, stated Monday that federal law enforcement would intervene if an abortion clinic/reproductive health center was "under attack".
Garland stated, "We will continue protecting those who seek to obtain or provide reproductive healthcare services."
Garland cited Freedom of Access to Clinic Entrances Act (FACE Act), which prohibits people from preventing other patients from accessing health care clinics.
Garland stated in the statement that the department had obtained civil and criminal remedies for violations of FACE Act laws since 1994 when it was first signed into law.
Texas' new law prohibits abortions after medical professionals detect cardiac activity. This usually occurs around six weeks. Many women don't realize they are pregnant until it is too late.
There are no exceptions to the ban for incest or rape, except for medical emergencies.
The law does not create criminal penalties for abortion seekers. It gave citizens the power to enforce the law, allowing private individuals and women to sue those who had abortions.
It is unclear if the FACE Act will be enforced in Texas to deter people from suing those seeking abortion.
Texas Governor Greg Abbott signed the law (known as SB 8), on May 19.
Garland stated that the Justice Department is looking into "all options to challenge Texas SB8". The federal agency will continue to work to make sure that people seeking abortions are not intimidated.
He stated that he would not tolerate violence against anyone who seeks to access or provide reproductive health care services, or physical obstruction, in violation of the FACE Act.
