A judge ruled Thursday that a Marjory Stoneman Dougans school resource officer who was accused of concealing during the 2018 school shooting which left 17 people dead will face criminal charges.
According to the Associated Press, Prosecutors claimed that Scot Peterson, Broward County Deputy, failed to protect teachers and students as the shooter made his way through school.
Peterson, 58, tried to get the charges dropped, but Broward Circuit Judge Martin Fein stated that a trial on child neglect charges could proceed, according to Sun-Sentinel.
Peterson's defense attorneys argued that the negligence charges against him don't apply because they apply to child caretakers. However, the judge ruled that a jury should have the power to determine if a school resource officer is a caregiver.
Peterson will next appear in court on Dec 9.
Peterson said to Local10 that he would "never forget that moment" following Wednesday's court hearing.
Peterson stated, "Never would I allow anyone to die knowing that an animal was up in my building."
Surveillance footage has shown that Peterson did not enter the building. According to Local10, Peterson claimed that he was calling for help from outside school buildings as he didn’t know where Cruz was.
Nikolas Cruz is charged with 17 murders in February 2018 shooting at Marjory Stoneman Doug. Cruz could face the death penalty if convicted. Cruz's defense lawyers have stated that he would plead guilty to the crime and receive a life sentence. However, prosecutors want him to be tried before a jury to determine his sentence.
