Andrew Cuomo, who had previously admitted to investigators that he groped his ex-staffer, has now filed a criminal complaint against him, according to an upstate sheriff's department.According to The New York Post, the Albany County District Attorney's Office was already investigating Cuomo in connection to at least one additional allegation of sexual harassment.According to the newspaper, she filed her complaint Thursday afternoon at the Albany County Sheriff's Office.Cuomo may be arrested if Cuomo is found to have probable cause to believe that the woman claims.According to a spokesperson for Albany County Sheriff Craig Apple who spoke to NBC News, the woman who filed that complaint was named as "Executive assistant #1" in a damning report by Letitia James on Cuomo and his alleged sexual harassment against nearly a dozen women.Apple explained to The Post that the end result could be "it sounds substantiated" and an arrest was made. Apple said that it was up to the DA's discretion to prosecute the arrest.CNBC reached out to Apple for comment but Apple didn't immediately respond.CNBC reached out to Albany County DA's Office for comment. If charges are filed, they would prosecute any case arising from the complaint. James has been asked by at least three other DA offices in Manhattan, Nassau, and Westchester to provide investigative materials in connection with the Cuomo probe.James retained lawyers to investigate and concluded that Cuomo had sexually harassed at most 11 women who worked or had worked for state agencies, retaliated against one accuser, and governed a toxic workplace culture filled with intimidation and fear.This report details instances where women touched women in ways that made them uncomfortable and also makes comments that made them feel uneasy.The James report details the claims of Cuomo's first female executive assistant #1.According to the report, "from late 2019 onwards, Governor engaged in inappropriate conduct with Executive Assistant#1 ("Executive assistant#1")," which is a female.The report stated that the pattern of conduct consisted of: (1) intimate and close hugs; (2) kisses and kisses on the forehead and cheeks; (3) touching Executive Assistant #1's butt while he hugs him and, on one occasion taking selfies with him; (4) jokes and comments by Governor about Executive Assistant #1’s personal life and relationships. This included calling her and another assistant "mingle moms".According to the report, Cuomo also asked her "multiple times" if she had cheated on her husband and asking her to help him find a girlfriend.According to the report, these offensive interactions culminated in an incident at The Executive Mansion in November 2020, when Governor, while hugging Executive Assistant #1 again, reached under her blouse, and grabbed her breast."According to the report, Executive Assistant #1 kept the groping incident a secret for over three months and intended to keep it "to her grave." But, she became emotional while watching Governor state at a press conference on March 3, 2021. He claimed that he had never touched anyone in an inappropriate way."She confided her concerns to her colleagues, who then reported them to the Executive Chamber's senior staff."Another incident was described in the report, which occurred on December 31, 2019. Executive Assistant #1 was working with Cuomo at his Executive Mansion in Albany when the Governor asked her for a "selfie" photo.According to the report, Governor Cuomo stood beside Executive Assistant #1 on her left as she took a selfie using her right hand. "Executive Assistant #1 held the camera and Governor Cuomo moved his hand to grab her cheek. He then began to rub it. It lasted for at least five minutes.Cuomo is currently in his third term and strongly denies sexual harassment of any woman, even Executive Assistant #1.In the days that have passed since James' report was published, it has been apparent that the governor has lost virtually all his political defenders.President Joe Biden, New York's U.S. senators Majority Leader Chuck Schumer, and Kirsten Gillibrand, along with many other Democrats, and the head for the party in New York, have all called on Cuomo.Cuomo was warned by a top committee of the state Assembly that it would soon close an impeachment investigation into his conduct and requested evidence to support the probe.Cuomo will likely be impeached within the next few months.Keep checking back for more updates.
