Trump's legal team better be able to get him to plead insanity at trial, a Harvard law professor says

If Donald Trump goes to trial, a Harvard law professor suggests that he plead insanity.

The expert on constitutional law shared his thoughts on the new video message to the January 6 panel.

I don't envy the lawyers who agree to represent him if this is the "defense" at Trump's upcoming trial.

They should be psychiatrists who can get their client to plead insanity.

Trump's rebuttal to the January 6 committee was posted to Truth Social on Friday, the day after the House panel released its final report on the Capitol riot. There were revelations in the report about the former president's involvement before and during the Capitol riot.

The committee members were called very bad people by Trump in the video. The panel didn't produce a single shred of evidence that Trump wanted violence at the Capitol, according to Trump.

In the past, people have suggested that Trump consider an insanity defense. The former Justice Department official made a similar comment when he weighed in on the House select committee's intention to subpoena Trump.

"I can't see it in any legal way helping him unless he is trying to go for the insanity defense, which this paper seems to be, you know, to be some evidence of," he said.

The House panel asked the Justice Department to prosecute Trump on four charges. Conspiracy to cheat the US, conspiracy to make false statements, and inciting an insurrection were included. Trump said in a Truth Social post that the move made him stronger.

Tribe and a spokesman for Trump didn't reply to Insider's requests for comment.
