Since Texas views carrying a gun as a constitutional right, people are getting confused by the complex laws. After taking a gun somewhere they shouldn't have, many students in the last year and a half have signed up for an LTC class in hopes of avoiding a conviction for carrying a weapon in public.

When he looked at the Texas Department of Public Safety website, he found that his experience wasn't unique. The number of convictions for carrying weapons without a license went from 1,049 in 2020 to nearly 7,000 last year, a jump of 550%. The state had a carry law.

No Obvious Explanation

It is not known why convictions for carrying a weapon have gone up so much. The law enforcement agencies were contacted by HuffPost. Few said anything. Some people thought that confusion might help account for the trend.

Harris County District Attorney Kim Ogg wrote in an email to HuffPost that the increase in carrying cases is alarming.

In Harris County, we seem to have filed more than one charge against some suspects which suggests that defendants freed on bond have been charged with the same crime more than once. There may be a lack of education about the constitutional carry laws or other laws regarding the possession of firearms around the rest of the state.

Permitless carry sounds easy, but gun laws are complex. Weapons are generally not allowed in airports, courthouses, hospitals and schools under the new law. A sign can be displayed by a private business prohibiting people from bringing in guns.

You can't bring a gun into a place that makes more than half of its revenue from booze. It is possible to take a gun into a bar if the bar's liquor license deems it a restaurant.

Those with licenses and those relying on the constitution are allowed to carry handguns without a permit.

Concealed carry is one of the perks of getting a license, it allows the holder to carry a concealed weapon in most other states, and license holders only have to submit federal background checks for application and renewal instead of buying a gun.

The law favors the holders of long term care insurance. License holders are allowed to carry a gun with a blood alcohol content of 0.08 or higher. It's against the law to drink alcohol and carry a gun at the same time. Under federal law, carrying a gun within 1,000 feet of a school is not allowed, but the license holder can bring a gun into a school.

All these details are explained by the once- required classes. Unholstering a handgun while inside a car is a crime if you read a news article that says you can.

It is not clear how confusion would translate into more charges. Someone who hides a handgun is not likely to get caught.

Many people are charged with carrying a weapon after police arrest them for something other than carrying a weapon.

Felons caught with guns are the only people who can be seen with a weapon. Texas counts the crime of possession of a gun even though it is a felony.

I don't have an explanation for it, that's kind of shocking to me. It is difficult to get arrested for carrying a weapon in Texas.

The introduction of permitless carry may not account for the shift since it can take several months for defendants to be charged and convicted. There was a historic and sustained spike in gun sales that started during the COVID-19 Pandemic.

The number of people charged with carrying a weapon more than doubled in two years in Harris County. The numbers for this year were incomplete.

More Guns At Airports

Those trying to take guns onto planes in their carry-on bags are the group that gets charged more often. The number of gun catches at Texas airports doubled in the year after.

The rise in Texas unlawful carry convictions is not explained by those cases alone. In Texas, the TSA recorded 1,055 firearm catches last year, compared to 570 the year before. If each of those cases resulted in a conviction, it would not be enough to explain the spike.

The Case Of Guido Herrera

The trend has mostly flown under the radar, but one case became a national news story.

The Galleria Mall in Houston was entered by a man with a semi-automatic rifle slung over his shoulder and a Bible. A cop working as a security officer tackled a man at a children's dance event. Police found 120 rounds of bullets in the cargo pockets of his pants when they arrested him.

It has always been legal in Texas to openly carry long guns.

There were signs at the mall warning people not to bring guns, but permitless carry protected his client because it wasn't clear whether the restrictions applied to the mall in general or to individual stores.

Merjanian said that he did not do anything wrong. He bought a hat at the mall. He didn't want someone to take the rifle from his car. He had a leather mask covering his nose and mouth. He was pegged as a Blue Lives Matter type by the skull logo.

Merjanian said that the cartoon shows the support of law enforcement. Guido had no intention of hurting anyone.

The police accused him of brandishing the rifle to threaten others.

After the Galleria arrest, he went to Houston's FBI Office to speak with the director. As he entered the parking lot, he had a gun in his lap.

Police charged the man with carrying a weapon without aholstered for leaving the gun in plain view.

After pleading guilty to carrying a weapon, a jury found him guilty of disorderly conduct.

He was sentenced to 18 months in prison for the two crimes. The Argentine national, who has lived in the US since he was a child, lost his status as a legal permanent resident because of the convictions and now faces deportation.

Critics saw the sentence as light for someone arrested on suspicion of shooting up a children's dancing event.

Had he taken the time to get a license to carry, he might have understood the state's gun laws to avoid conviction for carrying a weapon.

The statistics will show that more people have run afoul of the law while carrying a weapon without a license. The state of Texas didn't implement constitutional carry until September, making it the first full year under it.

More people are carrying guns, but they don't know what the rules are. Data speaks for itself.
