According to complaints filed by their attorneys, the two California-based employees were fired for being part of a group that was discussing and drafting letters that were critical of Musk's return to office policy.
The policy of making all workers return to the office was put in place at the end of May. Musk was accused of violating the anti-harassment policy of the company. Two employees were fired for filing complaints. One had just gotten a raise the month before, and the other was told their discussions were an attack on the company.
Both employees said they were fired for discussing the issues, even though the draft letters were never sent inside.
Musk-owned companies have been accused of retaliating against workers who take collective action related to working conditions, which is against federal labor laws. Employees have the right to engage in protected concerted activities, which include speaking to each other to help each other. There were eight former employees who claimed they were illegally fired after writing a letter calling for stronger "zero- tolerance policies" following sexual harassment allegations against Musk.
The same San Francisco law firm was retained by those employees who filed a complaint with the National Labor Relations Board.
Around the time of the complaint, hundreds of SpaceX employees signed an open letter castigating Musk, saying it was an embarrassment and a distraction.
Sexual harassment, racial discrimination and harassment, and failure to provide 60 days advance notice of layoffs are just a few of the issues that have been brought to the attention of the company.
The company's public relations department was abolished in 2019.
