Jack Sweeney said he wasn't concerned about the legal threat.
Musk said he would take legal action against Sweeney on Wednesday.
Musk doesn't have much of a case, but a legal battle may be expensive.
Jack Sweeney is a college student who tracks Musk's private jet.
"I don't think I'm worried because atweet is just atweet, you know what I mean?" Sweeney spoke to Insider on Thursday. A lot of people think that there isn't much ground for him to stand on.
On Wednesday, the account run by Sweeney that tracks Musk's private plane, as well as over 30 other accounts that he runs, including his personal profile, was suspended by the social media company.
"Last night, car carrying lil X in LA was followed by crazy stalker, who later blocked car from moving and climbed onto hood," Musk said on Wednesday night. The organizations that supported harm to my family are being taken to court.
Accounts that share an individual's live location are no longer allowed. The account was temporarily restored on Wednesday night and he received an email reminding him to "please refer to our updated policy regarding location sharing to prevent further account restrictions" but the account was again disabled within a few hours.
Musk posted a video that he said showed a man who followed the car that was carrying his son.
Sweeney doesn't know what the video has to do with him. He uses bots to find publicly available flight data and post it on the internet. The college student keeps track of their accounts on social media.
He said that the last time he sent a message from his account was 24 hours before the event. I don't really know if he's on it.
A request for comment was not responded to by Musk or the person who answered it.
He was home from college when he heard about Musk's legal threat.
He said that he was surprised for a short time, but then he thought rationally. He's trying to scare me and it's not going to work.
According to Insider Musk doesn't have a good case because he can't claim an evasion of privacy with respect to information that is already publicly available.
Gordon said that a legal battle with one of the richest people in the world will be expensive.
Losing a lot of money in a lawsuit is possible in the US judicial system. Wealthy people often file lawsuits over these issues. It's an attempt to intimidate someone who can't afford it.
Sweeney told Insider he's been told to reach out to the Electronic Frontier Foundation and other digital rights groups for support and he's already talked to some people about the lawsuit.
