New federal protections for same-sex marriage are set to become law on Tuesday when President Joe Biden signs the Respect for Marriage Act in a White House ceremony.

The legislation will be signed by Biden on the South Portico.

After the House passed the legislation last week and the Senate passed it in November, Vice President Biden signed it.

The federal government is required to recognize same-sex marriages if the legislation is passed.

The bill doesn't require states to issue same-sex marriages because the federal government can't force states to do so.

The bill was announced in the summer after the Supreme Court ruled in favor of abortion rights. The rights to birth-control access and same-sex marriage were suggested by Justice Clarence Thomas in his concurring opinion. In 2015, the Supreme Court granted the right to same-sex marriage in every state. If the Supreme Court overturns Obergefell, 35 states still have laws on the books that ban same-sex marriage, and they could be triggered back into effect. The legislation will be taken up by the Democrats before the next session of congress.

The Senate amended the bill to get the Republicans to vote for it. The new provisions make it clear that religious organizations that do not support same-sex marriage will not lose their tax-exempt status. The bill was voted in favor of by 12 Republican senators.
