Supreme Court Justice Samuel Alito made a joke about black children wearing Ku Klux Klan outfits.
While the justices were hearing oral arguments in a case that will determine if an anti-discrimination law in Colorado violates a web designer's first amendment right to freedom of speech because she only designs wedding websites for heterosexual couples
Jackson had a scenario in which a photography business wouldn't take photos of a mall Santa Claus with children who are not white. Alito asked if a Black Santa should have to take a photo with a child dressed in a Ku Klux Klan outfit if he doesn't want to be pictured with the child.
Colorado's solicitor general said that the Ku Klux Klan outfits are not protected.
If a child is "Black or white or any other characteristic," the same law would apply to the KKK outfit a child wears.
"Do you see a lot of black kids in Klan outfits?" Alito said something funny. It's all the time.
