The governor of Texas accepted the resignation of the district attorney of El Paso.

Abbott accepted the resignation of the District Attorney for the 34th Judicial District, Culberson, Hudspeth, and El Paso counties.

The letter was sent to the 409th District Court Judge by Richard Roman. Roman told the person on the phone that he couldn't talk.

After the Thursday hearing in which she invoked her right to silence under the Fifth Amendment, she was excused from court after only a few questions about the Walmart shooting gag order.

A copy of her resignation letter was included with the letter. The acting District Attorney will be the First Assistant, Mr. Al-Hanna.

The governor will have to appoint a successor to serve out the remainder of her term, which ends in 2024.

Steps to replace district attorney after resignation

The next steps in replacing Rosales were outlined by the El Paso County Attorney.

She resigned as a district attorney in Texas.

  1. She must submit her resignation to the governor.

  2. The resignation becomes effective if the governor accepts it or if it is the last day.

  3. After the resignation becomes effective, Rosales will stay in office as a holdover. She is free to do as she pleases until the governor appoints her replacement.

  4. The governor only has the power to choose a successor who is a licensed attorney.

  5. The candidate needs to meet certain requirements.

    1. You have to be at least 18.

    2. Register to vote.

    3. I have resided in Texas for more than a year and a half.

    4. Don't be a lawyer.

    5. Be acquitted of a felony.

    6. Not determined to be competent by a court.

The resignation of the El Paso County District Attorney doesn't mean the dismissal of criminal cases. The continued prosecution of existing cases is her responsibility. The law provides for a transition to ensure the protection of criminal cases in this district.

The district attorney didn't show up for the hearing on the Walmart shooting gag order violation.
