Embattled El Paso District Attorney Yvonne Rosales resigned Monday, which came to light during an in-person hearing in El Paso's 346th District Court ahead of a Wednesday hearing regarding the violation of the gag order issued in the walmart shooting case.

The tenure of Rosales will end at 5pm. She was scheduled to appear in court on December 14th to be suspended until the removal suit against her was resolved.

In her letter to the governor, she said that her first assistant, Salah George Al-Hanna, would take over as acting district attorney. She said that Al-Hanna will make sure that the daily operations of the office are running smoothly.

A spokeswoman for Abbott didn't know if the governor's office had received the letter by Monday.

The judge will make a decision on whether or not to suspend El Paso's district attorney.

The governor will have to appoint a new leader for the remainder of her term, which ends in four years, because she took office in January of last year.

The removal petition filed against her by her defense attorney didn't respond to a request for comment after Monday's announcement.

The case against Rosales was going to be prosecuted by the El Paso County Attorney.

Steps to replace district attorney after resignation

The next steps were outlined in the statement.

This is the first thing. She must submit her resignation to the governor.

The resignation of the district attorney doesn't mean the dismissal of criminal cases. The continued prosecution of existing cases is her responsibility. The law provides for a transition to ensure the protection of criminal cases in this district.

The road to resignation

Carmona filed a petition accusing her of "official misconduct and continued incompetence" in late August, after a capital murder case was dismissed due to "prosecutorial" reasons.

Carmona's petition stated that Rosales's incompetence and official malfeasance disqualified her from continuing in her elected position. She should be removed from the office she was elected to.

A little over a week later, Rosales filed a motion seeking Bernal's removal from the case over a conflict of interest and accused Carmona of being part of a conspiracy with other people.

The conflict of interest was caused by the fact that Dana and other attorneys who were terminated from the District Attorney's Office were employed by Bernal.

Moore and Underwood discussed the possibility of Rosales being removed from office via a petition on social media, according to the motion. Carmona's petition was filed the next day.

Judge Tryon Lewis dismissed all of the pleadings so far filed in the removal case because a citation hadn't yet been issued to the woman.

The judge rejected all of the pleadings filed by the district attorney.

After a number of failed attempts, the clock began to tick for her to respond. The request for more time to decide on the case was granted shortly afterwards.

After 10 days, Rosales denied all of the allegations, asserting that the petition lacked any "credible factual or legal basis".

More controversy

While fighting against the removal petition, she faced a wall of controversy related to the gag order issued in the case.

There were disagreements over personnel changes, the timing of case files, and her public communications about the case, which led to the motion to disqualify Judge Sam Medrano from the case. There was a delay in the hearing on the recusal.

There was a conflict between the judge and the person who was assigned to find out who broke the gag order.

In his report, he claimed that the office of Rosales broke the order when emails were sent to the media from the phone of a woman.

According to the report, Rodriguez had acted as a surrogate for the family on multiple occasions. He told his family not to "betray" him because he had "snipers everywhere," according to the report.

Rodriguez and the former assistant district attorney resigned.

In her response, Rosales accused Underwood of bias, again citing his involvement in a conspiracy to remove her from office, as well as questioning the reliability of audio recordings of Rodriguez, which were not submitted to her office within the required time frame.

The gag order will be at the center of a court hearing on Wednesday.
