Bernard is accused of violating state and federal law in how she reported and commented on the 10-year-old.

The 10-year-old was denied an abortion in her home state of Ohio due to the state's ban on abortions after six weeks of pregnancy, but she was able to get a medical abortion under Rokita's care.

The child's treatment was relayed to the Indianapolis Star by Bernard, who was accused of violating the federal Health Insurance Portability and Accountability Act by talking to the press about it.

According to the complaint, Bernard failed to follow mandatory reporting laws by not immediately reporting the child's abuse to the state when she was in Indiana.

The rape was reported to authorities in Ohio, where it happened, and Bernard also reported the abuse to the Indiana Department of Child Services, as well as to a state social worker before then.

The representatives for Bernard haven't responded yet.

The duty of the Office of the Attorney General is to make sure that doctors meet the standard of care. In our opinion, Dr. Bernard wasn't good enough.

Chief Critic

Bernard has filed a lawsuit against Rokita over the investigation into her practice and treatment of the 10-year-old. According to the lawsuit, the investigation into her was based on frivolous consumer complaints from people who only knew of Bernard through the media. She argued that the complaints posed a threat to patient privacy and the confidentiality of medical records.

What To Watch For

If the complaint is successful, it can result in a range of punishments, ranging from paying a fine to having the doctor's license taken away. The complaint doesn't specify any punishment the AG wants the board to impose on Bernard, but just asks the board to impose the appropriateDisciplinary sanctions The physician is asking the court to block Rokita from issuing any further subpoenas or launching investigations based on meritless complaints, as well as taking any steps that violate confidentiality rules surrounding those complaints.

Key Background

The case of the rape victim and her being denied an abortion in Ohio became a national flashpoint in the aftermath of the Supreme Court's decision to overturn the ban on abortion. As her comments to the press gained national attention, Rokita launched an investigation into Bernard to see if she reported the abortion to the state as required. In July, Bernard took the first step towards suing Rokita for defamation, after he made comments about her that were derogatory. While Indiana has enacted a near-total ban on the procedure, it is currently blocked in court due to litigation.
