The new date is Nov 2, 2022.

Trump's legal team wanted Supreme Court Justice Clarence Thomas to rule on their lawsuits challenging the 2020 election because they believed he would be their "only chance" at a ruling that could overturn the results.

Trump's attorneys should frame a lawsuit over Georgia's election result "so that Thomas could be the one to issue" an order saying Georgia is in legitimate doubt, according to an email from Trump's attorneys.

Thomas was the only chance for us to get a favorable judicial opinion before the new year.

"I think I agree with this, I received messages from legislators indicating they're leaning that way."

Thomas is the Supreme Court Justice who hears cases from the 11th Circuit Court of Appeals, which includes Georgia, so he could have issued an emergency order in a Georgia-based election case that temporarily blocked Congress from certifying the results himself.

The email exchange was part of eight emails from Eastman that were turned over to the House January 6 Committee in response to a court order.

Although they brought a lawsuit in the lower courts, they did not challenge Georgia's election results at the Supreme Court, but they did bring other cases protesting results in Pennsylvania and Wisconsin.

If we can get this case pending before the Supreme Court by January 5th, I think we can hold up the count of a state in congress.

Surprising Fact

More than 60 lawsuits were filed by Trump and his allies after the election. All of the Supreme Court challenges failed and the only one that succeeded affected a small number of Pennsylvania voters. Thomas dissented from a ruling that threw out a case brought by Pennsylvania Republicans over mail-in ballots because it could affect future elections. The justice said the court's decision not to take up the case was "inexplicable".

Tangent

Trump signed a sworn document attesting to false voter fraud claims that he allegedly made knowing they were false. The emails have to be turned over to the committee because of evidence of a crime. Further details of that email exchange were reported by Politico on Wednesday. The President and his lawyers will be pursued by the US Atty after the dust settles on this.

Key Background

Thomas has come under scrutiny for his involvement in cases related to the 2020 election as evidence has come out about his wife trying to challenge it. In order to encourage the White House Chief of Staff MarkMeadows to challenge the results, she communicated directly with him and sent emails to state lawmakers. The rally that preceded the Capitol building attack was attended by her. The House January 6 Committee interviewed Ginni Thomas as part of its investigation, though she continues to deny any wrongdoing, and she does not discuss her work with her husband. The controversy over her efforts has led many Democrats to call for Thomas to step aside from election-related cases, which he has so far refused to do. The full court ruled Tuesday that Graham must testify after all, despite Thomas temporarily blocking him from doing so.

Justice Thomas was seen as the only chance to stop the certification.

The Supreme Court considered these cases during the election.

A federal judge said that Trump committed fraud by pushing false voting claims.
