The death penalty was imposed by the jury after they found him guilty of killing Laci and the unborn son they were going to name "Conner" and dumping them into the bay.
In August 2020 the state's high court overturned the sentence after finding that potential jurors were wrongly dismissed because they disagreed with the death penalty but would be willing to impose it.
A judge is considering whether to grant a new trial after the justices said his jury may have been prejudiced.
In order to have better access to his attorneys, he was mostly kept at San Quentin.
